Welcome to SpitOut.com. These Terms of Use govern your access to and use of our website and services. By using SpitOut.com, you agree to comply with and be bound by these Terms of Use. If you do not agree with these terms, please do not use our platform.

1. Eligibility

  • You must be at least 21 years old to create an account and use SpitOut.com.
  • By using SpitOut.com, you represent and warrant that you meet this age requirement and that all registration information you submit is accurate and truthful.

2. Account Registration and Security

  • To access certain features of SpitOut.com, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update your information as necessary.
  • You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.
  • If you believe your account has been compromised or used without authorization, you must notify us immediately at support@spitout.com.

3. User Conduct

By using SpitOut.com, you agree that you will not:

  • Violate any applicable local, national, or international laws and regulations.
  • Post, upload, or distribute any inappropriate, defamatory, obscene, or harmful content.
  • Engage in fraudulent or deceptive activities.
  • Use the platform to harass, abuse, or harm another person.
  • Share or transmit personal contact information with other users for off-platform transactions or communications.
  • Attempt to access another user’s account or bypass any security measures on the platform.

SpitOut.com reserves the right to terminate or suspend your account if we suspect you have violated these Terms of Use or engaged in unlawful activity.

4. Content and Intellectual Property

  • User-Generated Content: As a user, you may upload, post, or share custom content on SpitOut.com. You retain ownership of any intellectual property rights in the content you create. However, by posting content on SpitOut.com, you grant us a non-exclusive, worldwide, royalty-free, and transferable license to use, display, distribute, and modify your content for the purpose of operating the platform.
  • Prohibited Content: You agree not to post any content that is unlawful, harmful, offensive, or that violates any third party’s intellectual property rights.
  • SpitOut.com Content: All content provided by SpitOut.com, including but not limited to text, graphics, logos, and software, is the property of SpitOut.com or its licensors and is protected by copyright and other intellectual property laws. You may not use or distribute this content without our prior written permission.

5. Fees and Payments

  • Buyer Payments: Buyers must make payments via the credit card processing options provided on SpitOut.com. Payment is required at the time an order is placed.
  • Seller Fees: Sellers are charged a 25% commission on the total transaction amount for each completed sale. There are no additional withdrawal fees when sellers transfer funds to their personal accounts.
  • Refund Policy: SpitOut.com operates with a no-refund policy for delivered custom digital content. Once the content is delivered and confirmed by the buyer, the transaction is final. Please review our Refund Policy for more details.

6. Digital Content Delivery

  • Sellers are required to deliver custom content within up to four (4) days of receiving an order. Buyers will be notified once the content is delivered.
  • Buyers are expected to confirm receipt of the content within 48 hours. Failure to confirm within this period may result in automatic confirmation by the system.
  • Sellers and buyers must comply with the Digital Content Delivery Policy. If disputes arise regarding content quality or delivery, SpitOut.com’s customer support team will intervene.

7. Prohibited Activities

The following activities are strictly prohibited on SpitOut.com:

  • Using the platform for illegal activities, including, but not limited to, fraud, money laundering, and human trafficking.
  • Exploiting any part of the platform for the distribution of unauthorized or pirated content.
  • Using automated tools or bots to interact with the platform or manipulate features like reviews, ratings, or rankings.

8. Termination of Use

SpitOut.com reserves the right to terminate or suspend your account at any time, with or without notice, if we believe that:

  • You have violated these Terms of Use.
  • You have engaged in fraudulent or illegal activities.
  • Your actions have caused harm or could cause harm to SpitOut.com or other users.

If your account is terminated, you may lose access to any content or services associated with your account.

9. Dispute Resolution

In the event of a dispute between buyers and sellers, both parties are encouraged to communicate directly to resolve the issue. If a resolution cannot be reached, SpitOut.com’s customer support team will review the dispute and make a final decision.

  • SpitOut.com is not liable for any disputes that arise from transactions conducted on the platform. Our role is to facilitate communication and transactions between buyers and sellers.

10. Limitation of Liability

  • SpitOut.com is not responsible for any indirect, incidental, special, consequential, or punitive damages that may arise from the use of the platform or any content provided by users.
  • Our liability to any user is limited to the total fees paid by that user in the twelve (12) months prior to the event giving rise to the liability.

11. Indemnification

You agree to indemnify and hold harmless SpitOut.com, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of the platform or violation of these Terms of Use.

12. Changes to the Terms of Use

We may update these Terms of Use from time to time to reflect changes in our practices or for legal or operational reasons. When we update these terms, we will revise the “Effective Date” at the top of this page. We encourage you to review these terms regularly to stay informed of any changes.

Payment Processing and Billing Descriptor
